Heard the parties through video conferencing. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the state.
The petitioner seeks pre-arrest bail in connection with Minapur P.S. Case No. 53 of 2019, pending in the Court of the Chief Judicial Magistrate, Muzaffarpur, registered under Sections 304B and 201/34 of the Indian Penal Code. The accusation is of killing of sister of the informant within one year of her marriage by her husband and in-laws by burn and disposed off the dead body.
Submission is that the petitioner is the husband of the
Patna High Court CR. MISC. No.34909 of 2020(2) dt.06-04-2021 2/2 deceased and after death of the deceased her maike people were informed, but, they did not turn up, thereafter, the dead body was disposed off.
Having regard to the facts and circumstances of the case, I am not inclined to grant the privilege of pre-arrest bail to the petitioner. The prayer for pre-arrest bail is rejected with direction to the petitioner to surrender before the Court below and seek regular bail, which shall be considered by the trial Court on its own merit, without being prejudiced of this order.
