JUSTICE PURNENDU SINGH ORAL ORDER 16-09-2025 Heard Mr. Dhananjay Kumar Singh, learned counsel appearing on behalf of the petitioner and Mr. Satya Nand Shukla, learned APP appearing on behalf of the State.
2. The petitioner apprehends his arrest in connection with Vaishali Cyber P.S. Case No. 12 of 2024 registered under Sections 419 and 420 of the Indian Penal Code.
3. As per the allegation made in the FIR, the petitioner, along with other co-accused, has committed fraud by committing Cyber crime in which total amount of Rs.10,31,000/- was transferred to the Indian Bank account of the petitioner bearing account no.6722793868.
4. Learned counsel appearing on behalf of the petitioner referring to Annexure 2 of the bail application submitted that the petitioner's employ I.D. number is 3989 and
Patna High Court CR. MISC. No.34619 of 2025(4) dt.16-09-2025 2/3 he is an employee of a company (Indus Craft) situated in Chennai. He has also brought on record that the petitioner has joined the said company on 19.01.2019 and the petitioner is getting remuneration from the company. The petitioner has no concern with the Cyber crime, which has been narrated in the FIR. The petitioner has clean antecedent. On these grounds, the petitioner seeks to be released on pre-arrest bail.
5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail. He submitted that common people are being cheated by Cyber crime and present is the case in which sum of Rs.5,30,000/- was withdrawn on 15.03.2024 and subsequently, on 16.03.2024 Rs.5,76,399/- was withdrawn from the informant's Indian Bank Account No.923999503 and total amount of Rs.10,31,000/- was transferred to the Indian Bank account of the petitioner bearing account no.6722793868. The intent of the petitioner is clear in view of the admission that the amount was lying in the account of the petitioner. The circumstances and manner in which crime has been committed, the bail application is fit to be rejected.
6. Having considered the rival submissions made on behalf of the parties, as well as, having perused the allegation made in the FIR it is admitted that a sum of Rs.10,31,000/- was

No information was given by the petitioner to the police nor he registered any case in this regard about the illegal transfer of huge amount into his account no.6722793868. I am not inclined to enlarge the petitioner on pre-arrest bail.
7. Accordingly, the present application stands dismissed.
