The petitioner seeks bail in Banshi P.S. Case No. 49 of 2019 corresponding to POCSO Case No. 65 of 2019, registered for the offence punishable under Sections 377/511 of the Indian Penal Code and section 8 of the POCSO Act. As per the prosecution case, this petitioner committed unnatural sex with the son (minor) of informant. It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. During course of investigation, the victim boy in his statement has stated that petitioner only tried to commit sexual assault which has also come in para 3 of the case diary and as such, no offence under Section 377 is made out. Petitioner is in custody since 30.12.2019 having clean antecedent. Investigation is complete.

Case No. 49 of 2019 corresponding to POCSO Case No. 65 of 2019.
