JUSTICE RAKESH KUMAR ORAL ORDER 22-02-2016 Heard Sri Vinod Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in connection with Parihar P.S. Case no.100/14 registered for the offence under Section 414/34 of the Indian Penal Code , has prayed for grant of anticipatory bail.
It was submitted by learned counsel for the petitioner that one of the accused, namely, Ajay Kumar was apprehended with stolen motorcycle. The petitioner was having inimical term with Ajay Kumar, co-accused and this was the reason that Ajay Kumar has falsely implicated the petitioner. He further submits that the petitioner is having clean antecedent and is a student of B.A, Part-I.

In view of nature of accusation and clean antecedent of the petitioner, let the petitioner, namely, Subodh Kumar be enlarged on bail, in the event of his arrest or surrender within six weeks from today, on furnishing bail bond of Rs.10,000/- ( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Parihar P.S. Case no.100/14 , subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure. (Rakesh Kumar, J) NKS/- U
