Allegation against the petitioner is of demand of bribe for alleged articles seized under the Bihar Prohibition and Excise Act.

Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 10.11.2017 passed in Cr. Misc. No.46844 of 2017, with an observation that he may renew his prayer for bail after framing of charge.

Submission of the learned counsel for the petitioner is that there is general and omnibus allegation and further no charge has been framed and the petitioner is in custody for more than four months. The petitioner is ready to abide by any condition imposed upon him.

Patna High Court Cr.Misc. No.39 of 2018 (2) dt.03-01-2018 2/2 Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Vigilance Ist, Patna in connection with Special Case No.87 of 2017/3 of 2017 arising out of Kiul G.R.P. P.S.Case No.19 of 2017, with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled.

With the aforesaid observation, this application is allowed.
