The petitioner is languishing in custody since 15.03.2019 in a case registered for the offences punishable under Sections 30(a) and 56(b) of Bihar Prohibition and Excise (Amendment) Act, 2018.

It is alleged that from the motorcycle of the petitioner 18 litres of illicit beer of kingfisher brand were recovered., It is submitted by learned counsel for the petitioner that the recovery has not been made from the conscious physical possession of the petitioner and he is not having any criminal antecedent.

Learned APP submits that the recovery has been made from motorcycle of the petitioner.

Considering the nature of recovery and the period

Patna High Court CR. MISC. No.34331 of 2019(2) dt.27-05-2019 2/2 under custody, coupled with the statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II -cum- Special Judge, Nawada in connection with G.O. Case No. 22 of 2019.
