JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 2 17-03-2021 As prayed for, let the learned counsel for the petitioners remove the defect(s), as pointed out by the office vide it's note, dated 11.12.2020, within four weeks of starting of the Court proceeding in physical mode properly.
Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the state in Virtual Court. The petitioners seek pre-arrest bail in connection with Pipra Kothi P.S. Case No. 291 of 2019, registered under Sections 304B and 120B of the Indian Penal Code.
The accusation is of killing of the daughter of the informant, Shiyapati Devi, by her husband and in-laws due to nonfulfillment of the demand of dowry within seven years of her marriage.
Submissions is that all the four petitioners are respectively father-in-law, mother-in-law, brother-in-law and sister-in-law of the
Patna High Court CR. MISC. No.34605 of 2020(2) dt.17-03-2021 2/2 deceased daughter of the informant, Shiyapati Devi. In fact, due to quarrel in between the deceased and her husband, Santosh Das, the deceased daughter of the informant committed suicide, but, with ulterior motive, all petitioners, who are father-in-law, mother-in-law, brother-in-law and sister-in-law, have been falsely implicated in this case with false allegation. Further, submission is that Santosh Das, husband of the deceased, is in custody since 10.11.2019. The petitioners have no criminal antecedent.
Having regard to the facts and circumstances of the case, let the petitioners, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Pipra Kothi P.S. Case No. 291 of 2019 shall be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
