JUSTICE BIRENDRA KUMAR ORAL ORDER 04-01-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201, 379,120(B) of the Indian Penal Code.

There is no eye witness of the occurrence of murder of the son of the informant. During investigation, it revealed that one Shailendra Kamat had committed the murder. Submission of the learned counsel for the petitioner is that only suspicion is there against the petitioner who is in custody since 05.09.2017.

Considering the aforesaid facts especially the fact that the material against the petitioner is suspicion, let the

Patna High Court Cr.Misc. No.56368 of 2017 (3) dt.04-01-2018 petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Nirmali Police Station Case No.41 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
