Ms. Meena Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 10-10-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State. Nobody appears on behalf of the complainant.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 494, 498A, 504, 34 of the Indian Penal Code.
3. As per the prosecution case, the allegation against the petitioner is to assault and torture the informant as the petitioner has solemnized second marriage with another woman.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this
Patna High Court CR. MISC. No.37683 of 2023(5) dt.10-10-2023 2/3 case. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. He submits that the petitioner has already deposited Rs. 85,000/- on 02.10.2023 in the account of his daughter and also deposited Rs. 1,60,000/- on 08.10.2023 in the account of his wife. Petitioner has no criminal antecedent as mentioned in para-3 of this application.
5. Learned APP for the State opposes prayer for anticipatory bail.
6. Mr. Ashok Kumar Sinha, learned counsel for the opposite party no. 2 submits that he has given no objection on behalf of the opposite party no. 2, so nobody appeared on behalf of opposite party no. 2.
7. Considering the facts and circumstances of the case and the statement made by learned counsel for the petitioner at bar, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Naubatpur P.S. Case No. 672 of 2022, subject to the condition as laid down

8. The petitioner will continue to deposit Rs. 5,000/- per month in the bank account of his daughter and Rs. 10,000/- per month in the bank account of O.P. No. 2. (Anjani Kumar Sharan, J) anand/- U T
