In this case, the petitioners are seeking anticipatory bail in connection with Surajpura P.S. Case No.95 of 2017, registered for the offence punishable under Sections 304 (B) and 120 (B) of the Indian Penal Code.

Allegation has been made that the daughter of the informant had been killed due to non-fulfillment of demand of dowry.

Counsel for the petitioners submits that the petitioners are 'Bhaisur' and 'Gotani' of the deceased and they have no concerned with the death of the deceased as they were/are living at Delhi. He further submits that the petitioner no.1 was working in Prudence Beverages Company, New Delhi since July,

Patna High Court CR. MISC. No.37066 of 2019(2) dt.18-06-2019 2/2 2016 and at the time of occurrence, he was living at New Delhi along with his wife. He further submits that father-in-law of the deceased has already been granted anticipatory bail by a Coordinate Bench of this Court vide order dated 27.02.2018 passed in Cr. Misc. No.19794 of 2018.

Looking to the entire facts and circumstances of the case, let the petitioners, above-named, be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Bikramganj, Rohtas, in connection with Surajpura P.S. Case no.95 of 2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure with a further condition that whenever the police will call the petitioners for the purposes of investigation and interrogation, they will remain present for the investigation. In the event of being absent on two consecutive dates without reasonable explanation, the present order will be treated to have been cancelled.
