Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 498A, 364, 34 of the Indian Penal Code.
As per the prosecution case, petitioners along with other family members committed torture on the informant's daughter due to non-fulfilment of dowry demand. Petitioner no. 1 is mother-in-law and the petitioner no.2 is the brother-in-law of the daughter of the informant. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this
Patna High Court CR. MISC. No.37623 of 2023(2) dt.11-07-2023 2/2 case. It is further submitted that the petitioners are separate in mess and business. Thrust of allegation is against the husband of the daughter of the informant who has already been granted bail by the co-ordinate Bench of this Court vide order dated 28.06.2023 passed in Cr. Misc. No. 36792 of 2023. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional District and Session Judge-I cum Special Judge in connection with ST No. 335 of 2022 arising out of Udakishunganj P.S. Case No. 233 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
