Heard the learned counsel, Mr. L. N. Das, for the petitioner.

It is admitted fact that eviction suit has been filed against the present petitioner who is nether plaintiff nor defendant in any other suit which are sought to be trialed along with this eviction suit.

The learned counsel for the petitioner submitted that earlier all the three suits were being trialed by the same Court but subsequently, the suit have been transferred to different Courts, therefore, the application was filed for analogous hearing but the Court below erroneously rejected the same.

Perused the order passed by the Court below. As stated above, this eviction suit filed under the Special Act, i.e. Bihar
Patna High Court CWJC No.3341 of 2015 (2) dt.10-03-2016 2/2 Building (Lease, Rent & Eviction) Control Act. The other suits are relating to question of title or mortgage etc. Further, the petitioner is not party in those suits. Further, it is admitted fact that one set of evidence is not required to be recorded. Further according to the Court below, the eviction suit is at advanced stage.

In view of the above facts and circumstances of the case, I find no reason to interfere with the impugned order. Thus, this writ application is dismissed.
