The petitioners seek bail in anticipation of their arrest in connection with Raniganj P.S. Case No. 37 of 2020, dated 21.01.2020, instituted for the offences under Sections 341, 323, 324, 325, 307, 354, 379, 447, 427, 504 and 506 of the Indian Penal Code.

The accusation against the petitioners is of assaulting the husband and the brother-in-law of the

The learned counsel for the petitioners has submitted that the F.I.R. has been registered after six days of the occurrence and that also without any explanation for such delay.

The petitioner No. 1 had earlier filed a case vide Raniganj P.S. Case No. 31 of 2020. It has further been submitted that there is a dispute with respect to a land falling in Khata No. 280, Plot No. 2856 having an area of 1.01 acres. The parties are staking their respective claims over the said portion of the land.

Though the petitioners are said to have injured two persons from the prosecution side, but there is no injury report on record.

Considering the aforementioned submissions advanced on behalf of the petitioners and taking into account the fact that the petitioners do not have criminal antecedents, they, in the event of their arrest or surrender before the learned Court below within a period of eight weeks, are directed to be released on bail on their furnishing

Patna High Court CR. MISC. No.35083 of 2020(2) dt.19-03-2021 3/3 bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-VI, Araria in connection with Raniganj P.S. Case No. 37 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
