====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 18-09-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in connection with Complaint Case No.23C of 2023 instituted under Sections 341, 323, 504, 498 (A) of the Indian Penal Code alongwith Section 3/4 of the Dowry Prohibition Act.
3. As per the prosecution case, the marriage of the complainant was solemnized with the petitioner on 12.07.2016 as per Hindu Rites and Rituals. On the eve of marriage several gifts including Rs.1 lakh were given by the parent of informant. It is alleged that after six months of marriage, the petitioner and his family members started pressurizing the complainant for
Patna High Court CR. MISC. No.41471 of 2024(3) dt.18-09-2024 2/3 demand of Rs.2 lakh or a Bullet motorcycle. On account of nonfulfillment of said demand of dowry, the complainant was subjected to cruelty and lastly thrown out of her matrimonial house.
4. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. He further submits that both the parties have compromised in the mediation. The mediation report is attached with the record, in which it is reported that the dispute between the parties has been resolved through the process of mediation. Learned counsel submits that petitioner has no criminal antecedent and he undertakes to cooperate in the trial of the case.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount to each to the satisfaction of the learned S.D.J.M., Birpur (Supaul) in connection with Complaint
