The petitioner seeks bail in Sitamarhi P.S. Case No. 676 of 2017 registered for the offence punishable under Sections 302/34 of the Indian Penal Code.
Informant is the brother of the deceased and he in his fardbeyan has stated that on 12.07.2017 at about 4:00 pm after closing his shop his brother went somewhere and did not return home, upon much search he could not be traced and in the morning of 28.07.2017, he was informed that someone has killed Jawed. Upon hearing the said information when he reached there, he found his brother lying in injured condition and found that he was still alive and thereafter he was carried to Sadar Hospital, Sitamarhi on Tempo and his injured brother
Patna High Court Cr.Misc. No.352 of 2018(2) dt.17-01-2018 2/2 disclosed that Pintu Kumar has fired on him at the instance of Md. Akbar and Md. Anwar. He further disclosed that the petitioner and others pressed his mouth so that he could not raise alarm. The reason for the said incident is that Md. Akbar, Md. Akhtar, md. Jumrati and md. Ahad used to threaten him that they will kidnap his sister. There is no allegation of any specific overt act against the petitioner neither any threatening by the petitioner to his brother. It has been further submitted that he is a student and one criminal case being Sitamarhi P.S. Case No. 688 of 2017 registered under the Arms act is pending. He is in custody since 13.09.2017.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P.S. Case No. 676 of 2017.
