The petitioner seeks bail in NDPS Case No. 19 of 2020, arising out of Industrial P.S. Case No. 58 of 2020, registered for the offence under Section 20, 22 of the NDPS Act. As per the prosecution case, this petitioner alongwith co-accused person were arrested on spot with total 50 Kg. of Ganja.

It is submitted on behalf of petitioner that no incriminating article has been recovered from the conscious possession of the petitioner and the vehicle in question does not belong to this petitioner. Petitioner claims clean antecedent and he is in custody since 28.06.2020.

Patna High Court CR. MISC. No.47384 of 2021(3) dt.13-01-2022 2/2 However, learned A.P.P. for the State opposed the bail petition and submitted that huge quantity of Ganja has been recovered, which is commercial quantity.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected.
