The petitioner has been in custody since 01.08.2018 in connection with Harsidhi P.S. Case No. 66/2018 registered for the offence punishable under Sections 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that the present petitioner is not named in the F.I.R., but subsequently, during the course of investigation, the name of the petitioner has surfaced and as such, he has been languishing in jail. It is further submitted that the entire allegation against him is based on suspicion and no recovery was made from his possession. In view of the aforementioned facts and circumstances, let the petitioner above named be released on
