Patna High Court CR. APP (SJ) No.2442 of 2024(5) dt.01-12-2025 2/2 Special Public Prosecutor for the State and learned counsel appearing on behalf of the informant.
2. Learned counsel for the appellants, after arguing for some times realizing his difficulty, seeks permission to withdraw this appeal with liberty to the appellants to surrender and seek regular bail.
3. Permission is accorded.
4. Accordingly, this appeal is dismissed as withdrawn.
5. It is made clear that if the appellants surrender and seek regular bail in that event, the learned trial court shall consider the case on its own merit without being prejudiced by the fact that appellants before this Court withdrew their anticipatory bail application.
6. The counter affidavit filed on behalf of the informant is taken on record.
