Mr.P.K.Pandey, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-02-2021 Pursuant to the previous order of this Court dated 9.9.2020, explanation dated 28.9.2020 of the Judicial Magistrate 1st class, Patna, is accepted.

Heard learned counsel for the petitioner, the State and perused the case diary.

The petitioner seeks regular bail in a case registered for the offence punishable under sections 364/120B of the Indian Penal Code.

As per the prosecution case, two sons of the informant were kidnapped by some unknown miscreants from the Jai Prakash Narayan International Airport, Patna and during course of combing operation one Ranjit Mandal alias Ranjit Don was apprehended who disclosed the name of the petitioner as his

Learned counsel for the petitioner submits that the petitioner's name has cme in the case on the basis of confessional statement of co-accused and save and except this, no other incriminating material has come against him. Even Test Identification Parade has not been carried out till date. As per paragraph 3 of the bail petition, the petitioner is accused in two other criminal cases in which he is already on bail. Charge sheet has already been submitted. Several similarly situated coaccused have already been allowed bail by different co-ordinate benches of this Court vide orders mentioned in paragraph 9 of the bail petition.

In the facts of the case, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate XV, Patna in Hawai Adda Police Station Case No. 170 of 2016 on the following conditions:-

(1) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and

Patna High Court CR. MISC. No.36661 of 2019(5) dt.25-02-2021 3/3 on his/her absence on two consecutive dates without sufficient reason, his/her bail bond shall be cancelled by the Court below.

(2) If the petitioner tampers with the evidence or the witnesses, in that case the prosecution will be at liberty to move for cancellation of bail.
