The petitioner seeks bail in Digha P.S. Case No. 57 of 2010 dated 08.03.2010 instituted under Sections 304B/34 of the Indian Penal Code.
This is the second attempt of the petitioner for bail as earlier such prayer was rejected by order dated 02.08.2014 in Cr. Misc. No. 26686 of 2014.
By order dated 12.04.2016, a report was called for from the Court below with regard to the status of the case, reason for delay and likely time by which the trial can be concluded. Pursuant to the same, a report has been submitted by the Additional District and Sessions Judge- IV, Patna under letter no. 105 dated 23.04.2016 in which it has been stated that within three months the matter is likely to be disposed off. In view of the aforesaid, this Court is not inclined
Patna High Court Cr.Misc. No.11448 of 2015 dt.27-04-2016 2/2 to reconsider the earlier rejection with regard to granting bail to the petitioner. Accordingly, the application stands dismissed. However, since the trial Court itself has submitted a report stating that the trial is likely to be concluded within three months, the Court directs that the same be done positively latest by 31st July, 2016.
