In this case, the petitioner is apprehending his arrest in connection with G.B. Nagar P.S. Case No. 30 of 2015 registered for offences under sections 147/148/149/323 /324/307/379/427/448 of the Indian Penal Code. An allegation has been made that on 28.11.2015, the accused persons in the name of clearing garbage started assaulting the Informant and there is also an allegation against the petitioner to have caused Farsa blow on the head of Kailash Yadav. The injury report of Kailash Yadav shows that he has received injury by hard and blunt substance and so much so that a counter case has also been filed by the petitioner. Both sides have received

Patna High Court Cr.Misc. No.10001 of 2016 (2) dt.03-03-2016 injury. Even the present petitioner has also received injury in the parietal region.

In that view of the matter, this Court would direct for release of the petitioner, namely, Shambhu Prasad Yadav alias Shambhu Yadav on bail in the event he would surrender within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with G.B. Nagar (Gautam Budh Nagar) P.S. Case No. 30 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioner for investigation/interrogation, he will remain present and if he would not present himself, the privilege of grant of anticipatory bail shall be deemed to have been cancelled.
