In this case, the petitioner is seeking anticipatory bail in connection with Motihari Town P.S. Case No.771 of 2015, registered for the offence punishable under Sections 302, 328/34 of the Indian Penal Code.

Allegation has been made that the marriage of the daughter of the informant was solemnized with the petitioner in the year 2007. For certain period everything was going in proper manner, however, at the later stage, they started making demand of dowry and ultimately, killed her daughter.

Learned counsel for the petitioner submits that Annexure-2

Patna High Court Cr.Misc. No.10017 of 2016 (2) dt.08-03-2016 2/2 series, sufficiently indicates that the victim was under treatment and so much so that the petitioner had informed the aforesaid fact to the informant side and the police also found that medicine was lying by the side of the victim.

Considering the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. If the petitioner surrenders before the Court below within four weeks from today and makes a prayer for regular bail, the Court below will pass the order without prejudiced to the order passed by this Court.
