JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 2397 of 2014 instituted for the offences punishable under Sections 323, 504, 498A and 379/34 of the Indian Penal Code.

Complaint case is that petitioner being the husband of the complainant was demanding Rs.50,000/- and though Rs.10,000/- was given but she was subjected to cruelty and harassment and ousted from the house.

Submission of learned counsel for the petitioner is that the whole allegation is false and concocted and as a matter of fact the complainant developed with illicit relationship with one Chandan Sahni and she is residing with him as wife and

Earlier notice was issued to opposite party No.2 and service report disclosed that she has received the notice but refused to acknowledge the same.

Heard learned APP also.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI, Muzaffarpur, in connection with Trial No. 1791 of 2019, arising out of Complaint Case No. 2397 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
