The petitioner seeks bail in Bakhtiyarpur P.S. Case No. 260 of 2019, registered for the offence punishable under Section 307 and other allied sections of the Indian Penal Code and section 27 of the Arms Act. Later on section 302 of the IPC was added.

Earlier the bail application of petitioner was rejected vide order dated 08.01.2021. Vide order dated 25.08.2021, report was called for regarding the stage of trial and same has been received (kept at flag 'A'), which reveals that case has been committed to the Sessions Court for trial. It is submitted on behalf of petitioner that petitioner is in custody since 25.09.2019.

Patna High Court CR. MISC. No.46715 of 2021(3) dt.27-10-2021 2/2 Considering the nature of accusation and stage of trial, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.

However, trial court is directed to expedite and conclude the trial as early as possible within a period of nine months failing which petitioner is at liberty to renew his prayer for bail.
