2. The petitioner apprehends his arrest in a case registered for the offence under Sections 363, 366A, 506 & 34 of the Indian Penal Code.
3. As per F.I.R., this petitioner is alleged to have kidnapped minor daughter of the informant for the purpose of marriage.
4. Learned counsel for the petitioner submits that F.I.R. has been lodged after a delay of 7 days. The victim, in her statement recorded under Section 164 Cr.P.C., has not supported the prosecution case. She denied the factum of kidnapping and has specifically stated that after being scolded by parents, she left her house. The trial court has assessed the age of the victim, as 18 - 19 years. Petitioner has got no concern with the alleged occurrence and has got clean antecedent.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the statement of the victim recorded under Section 164 Cr.P.C. and clean antecedent of petitioner, the prayer for anticipatory bail of petitioner is allowed.
7. Accordingly, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Katihar in connection with Rautara P.S. Case No. 35 of 2023, subject to condition as laid down under Section 438(2) of the Cr.P.C. / Section 482(2) of the B.N.S.S.
