JUSTICE AJAY KUMAR TRIPATHI ORAL ORDER 05-05-2016 No counter-affidavit on behalf of Bihar State Power (Holding) Co. Ltd. has been filed till date even though the writ application was filed after due service of notice on 21-8-2014. The husband of the petitioner died on 22-5-2012 while working as Assistant Executive Engineer under respondent nos.3 and 4.
As per Annexure-2 gratuity has been sanctioned in favour of the petitioner on 19-7-2013. The sanctioned amount is Rs. 10,00,000.00 , but only Rs.3,50,000/- has been released with an observation that the balance will be paid after availability of fund.
The Court not having been informed with regard to the
Patna High Court CWJC No.14385 of 2014 (2) dt.05-05-2016 2/2 current status, is left with no option but to direct the respondentauthorities of the Bihar State Power(Holding) Co.Ltd. that the balance of the amount of gratuity will be released in favour of the petitioner within a period of three months, if not already paid, from the date of production of a copy of this order. With the aforesaid direction this writ petition is disposed of.
