The petitioner is apprehending her arrest in connection with Bettiah Muffasil (Manuapul) P.S. Case No. 149 of 2013 for the offences instituted under Sections 341, 323, 324 and 307/34 of the IPC.

The prosecution story, in brief, is that on 01.03.2013 the petitioner and co-accused Fulmati Devi caught hold of the informant's father and co-accused Jhingan @ Nand Kishore Mahto and Anil Mahto gave him knife blow due to which his father fell down. Thereafter they fled away. Subsequently, the victim was taken to hospital at Patna.

Patna High Court Cr.Misc. No.15648 of 2016 (2) dt.03-05-2016 2/2 It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is a lady and Bhabhi of the informant. Prior to institution of the present case, she had instituted a case for offence under Section 498(A) IPC. She has been residing with her parents and she is claiming maintenance as per the order passed under Section 125 Cr. P.C. proceeding. She has no concern with the alleged occurrence. No specific overt act has been alleged against her. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of her arrest or surrender before the learned court below within a period of six weeks from today in connection with Bettiah Muffasil (Manuapul) P.S. Case No. 149/2013 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., West Champaran at Bettiah, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
