Petitioner seeks regular bail in a case registered for the offence punishable under Section 7 (a) of the Prevention of Corruption Act.

As per the prosecution case, petitioner was caught by the Vigilance team while accepting bribe of Rs. 50,000/-. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is submitted that petitioner is a Government servant and he undertakes that he will co-operate with the investigating agency, including FSL team by giving his voice sample and other relevant material, as and when required by them.

Learned counsel appearing for the Vigilance opposes the prayer for bail and submits that petitioner was caught while accepting bribe of Rs. 50,000/- and also refused to give his voice sample.

Considering the facts of the case, the period of custody of the petitioner and the undertaking given by the petitioner that he will co-operate with investigating agency, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum- Special Judge, Vigilance, Bhagalpur in connection with Special Vigilance case No.02/2021 (arising out of Vigilance PS Case No. 01/2021).
