ANJANA PRAKASH ORAL JUDGMENT Date: 14-07-2016 The Petitioner seeks revision of the judgment of conviction dated 4.12.2015 passed by the A.D.J. II, Jamui in Criminal Appeal No.19 of 2009, by which he has upheld the conviction of the Petitioner under the provisions of Arms Act and maintained the sentence of 2 years R.I. and fine of Rs.5000/-, in default of which R.I. for another three months, passed by the Judicial Magistrate, 1st class, Jamui in G.R. No.668 of 2008/Trial No.2666 of 2009 arising out of Laxmipur P.S. case No.78 of 2008 by judgment dated 2.2.2009. Having gone through the impugned judgment, I do not find any merit in the revision. However, considering the period of custody of the Petitioner, the sentence is modified to the period already undergone by him. However, he is required to deposit the fine
Patna High Court CR. REV. No.573 of 2016 dt.14-07-2016 2/2 as directed by the Court below within a period of eight weeks from the date of receipt of this order, failing which he shall be sentenced to imprisonment as directed by the court below.
With the aforesaid modification in sentence, the revision application stands dismissed.
