JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-01-2018 Prayer for bail of the petitioner was earlier rejected by this Court vide order dated 8.2.2017 passed in Cr.Misc. No. 54773 of 2016 with a direction to trial court to conclude the trial within a period of nine months and if not concluded petitioner was given liberty to move for bail.
Submission of learned counsel for the petitioner is that no substantial progress has been made in trial and petitioner is in custody for more than 15 months.
Heard learned APP also.
From perusal of the report it appears that now charge has been framed against the petitioner.
In such view of the matter, learned trial court is directed to expedite the trial as there was earlier direction to conclude the
Patna High Court Cr.Misc. No.60743 of 2017 (3) dt.24-01-2018 2/2 trial within nine months, and try to conclude it within a further period of seven months on day to day basis. At the same time, Superintendent of Police, Madhepura is directed to ensure the presence of the witnesses in court on the date fixed, so that trial be concluded within the specified period. The above directions must be complied in strict sense.
With the above observation, this application is disposed of.
