Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State through video conferencing.

The petitioner apprehends his arrest in connection with Barun P.S. Case No. 179 of 2020 registered for offence punishable under section 302/34 of the Indian Penal Code. The informant, Shivpujan Choudhary is the father of deceased Om Prakash Choudhary. He has stated in his fardbeyan that in the evening of 01.09.2020, he was present in his house. Meanwhile, co-accused Rajendra Gupta, Bhola Gupta

Patna High Court CR. MISC. No.46892 of 2021(2) dt.29-04-2022 2/3 and Raju Prasad Gupta came there. Raju Prasad Gupta entered into his house with a pistol and murdered his son Om Prakash Choudhary by opening fire arms. Thereafter, all the three accused persons became successful in fleeing away. The reason behind of occurrence was that the deceased had illicit relation with the wife of the present petitioner.

The learned counsel for the petitioner has submitted that Rajendra Gupta and Bhola Gupta, on whom, there was allegation to come to the house of the informant along with main assailant Raju Prasad Gupta, have been granted anticipatory bail by the coordinate Bench of this Court in Cr. Misc. No. 13293 of 2021 He has also submitted that the case of the present petitioner is on better footing.

Considering the above-mentioned facts and circumstances, let the petitioner above named, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No. 179 of 2020, subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the
