JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 414 of the Indian Penal Code.
The prosecution case is that the informant being Officer Incharge of Sarai police station received information that some miscreants have assembled at Sarai railway station premises for sale and purchase of theft vehicles. On raid being laid, the accused persons escaped from the scene but one Ranjeet Kumar Nirala was apprehended with Bolero vehicle who was driver, disclosed that co accused Karu Jha and this petitioner brought the vehicle from U.P. who are involved in sale and purchase.
It is submitted by the learned counsel for the petitioner
Patna High Court Cr.Misc. No.10594 of 2016 (2) dt.09-03-2016 2/2 that except confession of co accused Ranjeet there is nothing collected against the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Admittedly recovery has not been made from the petitioner. More over, similarly situated co accused Karu Jha whose name has been disclosed by the apprehended accused, has been granted anticipatory bail vide Cr. Misc. No. 41559 of 2015.
Considering the accusation against the petitioner based on confession of co accused and statement made in paragraph 3 of the petition that the petitioner has no criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with Sarai P.S. Case No.98 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
