Heard the learned counsel for the petitioner and learned counsel for opposite party no.2.

The petitioner apprehends his arrest for the offences alleged under Sections 498A, 323, 504 and 34 of the Indian Penal Code, registered in connection with Complaint Case No.1995(c) of 2019.

As per allegation, the petitioner was married to the

Patna High Court CR. MISC. No.47049 of 2021(3) dt.20-09-2022 2/3 complainant in the year 2015. The accused persons tortured her for non-fulfilment of dowry demand.

The matter was referred to the Mediation Centre. The mediation report dated 01.09.2022 is available with the record which shows that both the parties agreed to live separately and for this, the petitioner offered to pay Rs. 15,00,000/- (Rupees Fifteen Lakhs only) to the complainant. The complainant opposite party no.2 accepted that offer and gave her consent to finally compromise the case. That amount, as submitted by the learned counsel for the petitioner, has been paid to the complainant. It has also been agreed that there shall be no any claim in future against each other and they shall withdraw all the cases between them.

The learned counsel for the complainant has submitted that the complainant had demanded Rs. 25,00,000/-, but the agreement was reached at Rs. 15,00,000. Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Ritu Kumar, learned Judicial Magistrate Ist

Patna High Court CR. MISC. No.47049 of 2021(3) dt.20-09-2022 3/3 Class, Patna in connection with Complaint Case No. 1995(c) of 2019, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
