This application for anticipatory bail arises out of Complaint Case No.83 of 2018 for the offence punishable under Section 498-A of the Indian Penal Code and under Section 4 of the Dowry Prohibition Act.
It has been submitted by learned counsel for the petitioner that the petitioner and opposite party no.2 are staying together as husband and wife.
In view of the above submission, this bail application is allowed.
Let the petitioner, above named, in the event of his
Patna High Court CR. MISC. No.47376 of 2021(2) dt.02-02-2022 2/2 arrest/surrender within ten weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur, in connection with Complaint Case No. 83 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
However, at the time of accepting the bail bonds, the Court below will call the complainant and verify the fact whether she is staying with petitioner. If it is found that both the parties are staying together then the bail bonds of the petitioner shall be accepted. However, it is found that there is some dispute with regard to this fact, in such circumstance, the Court below will not accept the bail bonds of the petitioner and the petitioner shall be taken into custody.
