JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 09-05-2016 Heard Mr. Diwakar Prasad Singh, the counsel for the petitioners and Mr. M. Dayal, APP for the State. Both the petitioners are family members of the co-accused who is said to have enticed away the daughter of the informant and therefore facing accusations under Section 366(A) & 120-B of the Indian Penal Code vide P.S. Case No. 191 of 2015.
The counsel for the petitioners draws attention of the Court to the statement of the victim girl recorded under Section164 of Cr. PC and submits that the Court has assessed her 18 years of age whereas she disclosed her age as 19 years. Nothing has been alleged against the petitioners in the said

Considering the statement of the victim girl, the boy has been enlarged on anticipatory bail by this Court vide order dated 16.03.2016 passed in Cr. Misc. No. 12486 of 2016. In the facts and circumstances of the case, let the petitioners above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate II at Saharsa in Salkhua P.S. Case No. 191 of 2015 on condition that one of the bailors shall be his/their own/close family member. The petitioners shall appear on each date fixed at the trial. In case of default in appearance on two consecutive dates, the trial court shall have liberty to cancel their bail bonds. (Kishore Kumar Mandal, J) rohit/- U T
