Ms. Renu Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 323, 506 and other allied sections of Indian Penal Code.

As per FIR, this petitioner along with other accused persons gave iron rod blow on the head of the informant as a result of which informant sustained head injury. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. There is case and counter case. It is submitted that a simple altercation took between the parties due to land dispute. Injury allegedly caused by this petitioner is simple in nature. Petitioner has got clean antecedent.

Considering the simple nature of injury and clean

Patna High Court CR. MISC. No.38351 of 2022(2) dt.22-11-2022 2/2 antecedent, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in Madhuban P. S. Case No. 399 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
