The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Alauli P.S. Case no. 175 of 2023 instituted for the offence under Section 392 of the Indian Penal Code and later on 411 of IPC was added.

As per allegation in the FIR, some unknown miscreants snatched of Rs. 1,72,000/- from the informant while he was returning after taking the above said amount from market. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. The petitioners are not named in FIR rather their

No.40321 of 2024(2) dt.25-06-2024 2/2 name came in this case on the basis of confessional statement of other co-accused Kulkul Panjiyar before the police and he has already been granted regular bail by this Court vide order dated 19.12.2023 in Cr. Misc. No. 81795 of 2023. Nothing incriminating article has been recovered from the conscious possession of the petitioners. Except confession of other coaccused person, nothing consistent material has come against them.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Alauli P.S. Case no. 175 of 2023, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria subject to the conditions as laid down under section 438(2) of the Cr.P.C.
