JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 366 and 366A of the Indian Penal Code.

The prosecution case is that on 18.11.2015 the minor daughter of the informant namely Lovely Kumari who was sleeping in the house of co villager Julie Kumari, was abducted by Manish Kumar. It is alleged that abduction was facilitated by Julie Kumari, Kanhaiya Prasad, Govinda Prasad and this petitioner. It is submitted by the learned counsel for the petitioner that the petitioner is not in any way related to Manish. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. More over, from the accusation levelled it

Patna High Court Cr.Misc. No.10666 of 2016 (2) dt.10-03-2016 2/2 appears that it is a case of love affair when the boy is 19 years of age and the victim girl is 17 years of age. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the thrust of accusation against co accused Manish Kumar, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Saran at Chapra, in connection with Baniyapur P.S. Case No.277 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
