Perused the impugned order dated 12.08.2015 passed by the learned Sub-Ordinate Judge-III, Madhepura in T.S. No. 209 of 2010, whereby the learned court below has allowed the amendment application filed by the plaintiffs-respondents. 3.

It is submitted by the learned counsel for the petitioner that the suit is at the very initial stage i.e. evidence has not yet started.

In such view of the matter, the learned court below has rightly exercised the jurisdiction vested in it by law under Order 6 Rule 17 C.P.C. The petitioner, if so advised, may file additional written statement to amended portion in the court below. Therefore, I find no reason to interfere with the impugned order in exercise of supervisory jurisdiction. Thus, this writ application is dismissed.
