The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a) and 38(i) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, about 1013.88 litres of IMFL and 672 litres of beer was recovered from the truck of which the petitioner was the khalasi.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession or his truck. He has been falsely implicated in the case. He is in custody since 18.10.2020 and has no criminal antecedent. Charge sheet has been submitted in the case. Heard learned APP for the State.

Case no. 313 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge II-cum-Special Judge (Excise Act), Bhagalpur.
