The petitioner apprehends his arrest in Kotwali P.S case No. 292 of 2015 under Section 379, 419, 420, 414, 467, 468, 120B, 485, 486, 413, 487, 488 of the Indian Penal Code and under Section 27(B)(2), 27(6), 28, 28(A) of Drugs and Cosmetics Act, 1940.
The petitioner is licensee of Riya Medical Agency. A raid was conducted in the shop of petitioner and different medicines at serial No. 15 to 35 were seized. It is alleged that the medicines were found without any purchase slip. It is submitted that petitioner purchased the medicine from the company and it is no where stated that petitioner is selling spurious or expired medicine.

No.22342 of 2016 (3) dt.25-07-2016 2/2 Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in Kotwali P.S. Case No. 292 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
