The petitioner is languishing in custody since 24.03.2019 in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Sections 30(a) & 36 of the Bihar Prohibition and Excise Act. It is alleged that from the roof of the house of the petitioner, 2 litres of illicit Mahua liquor, equipments used for manufacturing liquor and raw materials were recovered. It is submitted by learned counsel for the petitioner that the recovery has been made from the joint family house of the petitioner and the petitioner is accused in one another case of similar nature in which he is on bail.

Considering the nature of recovery and the period under custody, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Rohtas, Sasaram in connection with Bikramganj P.S. Case No. 153 of 2019.
