The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420 and 201 of the Indian Penal Code.
It is alleged that the petitioner being the In-charge Principal of Sant Sri Barhana Mahila College did not handover the charge of the several documents including the pass-book, cheque book, cash book etc. and hence it was suspected that he defaulcated Rs. 50,000,00/-.
It is submitted by the learned counsel for the petitioner that the petitioner lodged Jagdishpur P.S. Case no. 106 of 2011 making accusation under Section 406, 409 and 420 of the Indian Penal Code against the then Principal Radhey Shyam Chaudhary and during investigation of the said case all
Patna High Court Cr.Misc. No.29612 of 2014 (3) dt.06-02-2015 the documents were seized by the police and the false case has been lodged against the petitioner on mere apprehension. The petitioner is accused in one other case in which he is on bail. Considering the nature of dispute and the case lodged by the petitioner at the earlier point of time, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Arah, Bhojpur in connection with Jagdishpur P.S. Case No. 52 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. (Dinesh Kumar Singh, J) P.K./- U T
