JUSTICE SUDHIR SINGH ORAL ORDER 18-04-2016 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners are apprehending their arrest in connection with Bakhri P.S. Case No. 293 of 2015 for the offences instituted under Sections 341, 323, 324, 326, 307 and 379/34 of the Indian Penal Code.
As per prosecution case while Kundan Singh the son of the informant Hardeo Singh was returning to his house on a cycle, all the accused persons dragged him towards orchard and relieved him of Rs.9,000/- in cash and a mobile. It is further alleged that the accused persons gave three knife blows as well as blow from the rod causing the injury the informant and they fled away, informant has asserted that on getting information about the incident he went to the place of occurrence and took his son to doctor for treatment.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. Petitioners have falsely been implicated in the present case. There is enmity between the parties. From perusal of injury report, it appears that the injury nos.1, 2 and 3 are simple in nature. As far as injury no.4 is concerned, same is swelling and the opinion has been reserved. No specific injury has been attributed against them. General and omnibus allegation has been made.
On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a
period of six weeks from today in connection with Bakhri P.S. Case No. 293 of 2015 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Begusarai, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
