JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 11-05-2022 By order dated 25.03.2022, the petition in respect of petitioners no.2 and 5 stands dismissed as withdrawn. Heard learned counsel for the petitioners and learned APP for the State.
The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
It is a case of assault and shot fire upon the informant as
Patna High Court CR. MISC. No.47775 of 2021(4) dt.11-05-2022 2/2 well as other injured persons.
It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that during the course of occurrence, eight persons received injury caused by fire arm. He further submits that there is case and counter case between the parties and both parties have sustained injuries in separate incidents.
Learned APP appearing for the State has opposed the prayer for anticipatory bail and submits that there is allegation of specific overt-act against the petitioners who opened fire due to which, the informant and injured persons suffered gun shot injury. Considering the aforesaid facts, I am not inclined to grant anticipatory bail of the petitioners.
