JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,342,353,332,333,323,304 and 427 of the Indian Penal Code. The prosecution case is that on 30.7.2014 at about 1.20 P.M. when the informant being Block Development Officer, Areraj was inviting objection with regard to SECC scheme, in the meantime, the accused persons entered into the chamber of the informant when the informant asked them to go out from the chamber then this petitioner attempted to assault and abuse and also smashed the government file.

It is submitted by the learned counsel for the petitioner

Patna High Court Cr.Misc. No.9174 of 2016 (2) dt.29-02-2016 2/2 that the petitioner has been roped in the present case since he made protest for committing illegality in implementation of the government scheme. It is further submitted that for the occurrence of 30.7.2014 at 1.20 P.M. the FIR was registered on the same day at 10 A.M. which reflects the malicious nature of accusation. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Motihari in connection with Gobindganj (Areraj) P.S. Case No.132 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
