2. The petitioner has preferred this application for grant of regular bail in connection with Kesariya P.S. Case No. 436/2024 dated 27.12.2024 registered for the offence punishable u/s 103(1) of the B.N.S.
3. As per the prosecution case, the informant received information that a dead-body is floating in water near Dhekhaha Sattarghat bridge. After giving information to S.H.O. Kesariya, the informant reached there and found that a dead-body is lying on the side of Satarghat Bridge. Thereafter, the dead-body was taken to Police Station and the informant claims that after committing murder by pressing neck and assaulting, some

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is not named in the F.I.R. During the course of investigation, spy disclosed the name of the petitioner and the co-accused person in the crime alleged. The petitioner is the full brother of the deceased. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 24.01.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner. In para. 121 of the case diary, the confessional statement of the petitioner is mentioned in which he has confessed his guilt and stated about the involvement of the co-accused, Sonu Singh in the crime alleged. As per the post-mortem report, the cause of death is due to head injury caused by sharp cutting object.

Considering the aforesaid facts and circumstances of the case as well as the heinous nature of offence against the petitioner, this Court is not inclined to grant bail to the petitioner and the same is rejected in connection with Kesariya P.S. Case No. 436/2024 pending in the court of learned C.J.M. East
