ANJANA MISHRA ORAL ORDER 23-08-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Kochadhaman P.S. Case No.229 of 2018 for allegedly having committed the offence under Sections 302, 201, 120B/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the entire allegation against the petitioner and other co-accused is based on suspicion and there is nothing on record to indicate that the petitioner had participated in the occurrence. It is further submitted that only because there is a matrimonial dispute, the name of the petitioner has been brought along with other persons. He further submits that co-accused Noorjabee Begum and Sabera Khatun have since been extended the privilege of

Patna High Court CR. MISC. No.37672 of 2019(3) dt.23-08-2019 2/2 anticipatory bail in Cr.Misc. No.15921 of 2019, vide order dated 21.05.2019.

Considering the aforementioned facts and circumstances and that the petitioner is not having any criminal antecedents and further that there is no specific allegation against the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj, in connection with Kochadhaman P.S. Case No.229 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
