The petitioners are apprehending arrest in a case registered for the offences punishable under sections 341,323,307,447 and 504/34 of the Indian Penal Code. The prosecution case is that in the background of a dispute with regard to the partition of a babool tree the petitioners and co accused Belu Bhuiya assaulted the son of the informant. It is submitted by the learned counsel for the petitioners that the injury has been found to be simple in nature. Statement to the aforesaid effect has been made in paragraph 8 of the petition. Statement has also been made in paragraph 3 of the
Patna High Court Cr.Misc. No.12811 of 2016 (2) dt.29-03-2016 2/2 petition that the petitioner has no criminal antecedent The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioners by the learned court below in case the petitioners surrender within six weeks from today in connection with Raushan Ganj (Bankey Bazar) P.S. Case No. 104 of 2015 pending in the court of learned JM Ist Class, Sherghati (Gaya).
This application is disposed of with the aforesaid observation/direction.
