The petitioner apprehends his arrest in connection with Warisaliganj P.S. Case No. 374 of 2021 registered under Sections 30(a) and 41 of the Bihar Prohibition and Excise Act, 2016.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case merely on the basis of secret information. Further submission is that on perusal of the seizure list, it appears that the alleged recoveries have been made from the bush situated at southern boundary wall of Referral Hospital at Mafigarh.

No.38192 of 2022(5) dt.09-01-2023 2/2 Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of the Exclusive Special Excise Court No. 2, Nawada in connection with Warisaliganj P.S. Case No. 374 of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
